ORDINANCE NO. 1611

AN ORDINANCE ANNEXING ADJACENT AND CONTIGUOUS TERRITORY

WHEREAS, the Town of St. John, Lake County, Indiana, is aware that certain property adjacent to or abutting the westerly boundary of the Town of St. John, commonly known as 9740 White Oak Avenue, should be annexed to the Town of St. John; and

WHEREAS, the parcel is in excess of one-eighth (1/8) contiguous to the town limits of the Town of St. John; and

WHEREAS, the territory sought to be annexed is needed and can be reasonably utilized by the Town of St. John for its development in the reasonably near future; and

WHEREAS, the real estate commonly known as 9740 White Oak Avenue will be connected to sanitary sewer service and water service provided by the Town of St. John; and

WHEREAS, the Town of St. John, by resolution, has adopted a written Fiscal Plan pursuant to I.C. 36-4-3-13 with respect to this real estate.

NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of St. John, Lake County, Indiana:

SECTION ONE: That the following described land be, and the same is, hereby annexed to and declared a part of the Town of St. John, Lake County, Indiana, to-wit:

Legal Description for 021N08471:

The Southwest Quarter of the Northeast Quarter of Section 31, Township 35 North, Range 9 West of the Second Principal Meridian, in Lake County, Indiana, except that part lying Westerly of the center line of Bull Run Ditch; and also:

The Southeast Quarter of Section 31, Township 35 North, Range 9 West of the Second Principal Meridian, in Lake County, Indiana, excepting the following described parcels:

That part of the Northwest Quarter of Southeast Quarter lying Westerly of the center line of Bull Run Ditch; and that part of the Southeast Quarter of the Southwest Quarter of the Southeast Quarter (SE.1/4, SW ¼, SE ¼) of Section 31, Township 35 North, Range 9 West of the Second Principal Meridian in Lake County, Indiana, being more particularly described as follows: Commencing at the Southeast corner of said SE. 1/4, SW. 1/4 , SE. 1/4; thence West along the South line thereof, a distance of 250 feet to the true Point of Beginning hereof; thence North, parallel with the East line of said SE. 1/4 , SW. 1/4 , SE. 1/4 , a distance of 460 feet, more or less, to the centerline of Bull Run Ditch; thence Southwesterly, along said centerline, to the West line of said SE. 1/4, SW. 1/4 , SE. 1/4 ; thence South along said West line, 315 feet, more or less, to the Southwest corner of said SE. 1/4 , SW. 1/4 , SE. 1/4 ; thence East along the South line of said SE. 1/4 , SW. 1/4 , SE. 1/4 , a distance of 413.72 feet to the Point of Beginning.

SECTION TWO: That the property sought to be annexed will be assigned to Ward One (1) as a voting district in the Town of St. John pursuant to I.C. 36-4-3-4(g).

SECTION THREE: That the zoning of said parcel of real estate is hereby determined to be R-1, Single Family Residential District.

SECTION FOUR: Be it further ordained that the boundaries of the Town of St. John, Lake County, Indiana, shall be, and the same are, hereby declared to be extended so as to include all of the real estate hereinabove described as part of the Town of St. John, Lake County, Indiana.

SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, promulgation, and approval by the Town Council and publication in accordance with the law.

PASSED AND ADOPTED by the Town Council of the Town of St. John, Lake County, Indiana, this 23rd day of July, 2015.
