TOWN OF ST. JOHN, LAKE COUNTY, INDIANA

ORDINANCE NO. 1598

AN ORDINANCE AMENDING TOWN ORDINANCE NO. 1287, “BEING AN ORDINANCE AMENDING ORDINANCE NO. 511, AND ALL AMENDMENTS THERETO, INCLUDING BUT NOT LIMITED TO ORDINANCE NO. 1198, ALL OF THE SAME BEING AN ORDINANCE REGULATING TRAFFIC, AND ESTABLISHING FINES AND PENALTIES FOR VIOLATIONS OF TRAFIC REGULATIONS IN THE TOWN OF ST. JOHN, LAKE COUNTY, INDIANA.”, AND ALL MATTERS RELATED THERETO.

WHEREAS, the Town Council of the Town of St. John, Lake County, Indiana (hereinafter, the “Town Council”), did, on the 9th day of April, 1979, pass and adopt Town Ordinance No. 511, the same being an Ordinance regulating traffic and establishing fines and penalties for violations of traffic regulations in the Town of St. John, Lake County, Indiana; and

WHEREAS, the Town Council has, since the adoption of Town Traffic Regulations Ordinance No. 511 on April 9, 1979, amended and modified same on numerous occasions based upon circumstances presenting to the Town Council; and

WHEREAS, the Town Council has been informed and advised by the Police Chief of the Town Metropolitan Police Department that Town Ordinance No. 1287, which amended Town Ordinance No. 1198, pertaining to certain Traffic Regulations for parking restrictions, now requires updating and amendment for the public health and safety of the residents of the Town affected thereby; and

WHEREAS, the Town Council has been informed and advised by its Chief of Police that said Town Traffic Regulations Amendatory Ordinance No. 1287, which amended Town Traffic Regulations Amendatory Ordinance No. 1198, set forth traffic regulations regarding “parking time limited on certain streets”; and

WHEREAS, the Town Council, being duly advised by its Chief of Police, and having reviewed said recommendation, has determined that two (2) additional public streets in the Heron Lake Subdivision in the Town of St. John not included in the “parking time limited on certain streets” regulations should properly be included therein for the benefit of the residents and citizens affected thereby; and

WHEREAS, the Town Council, being duly advised, and having considered the recommendation of the Town Chief of Police, and circumstances presented, now concurs that it is advisable, necessary, and in the best interests of the residents of the Town, and specifically in the Heron Lake Estates Subdivision, to amend Town Ordinance No. 1287, which amended Town Ordinance No. 1198, which all originate in the enabling Ordinance No. 511, to add two (2) streets upon which parking time shall be limited in the Town Traffic Regulations Ordinance.

NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF ST. JOHN, LAKE COUNTY, INDIANA, AS FOLLOWS, NAMELY:

SECTION ONE: That Town Ordinance No. 1287, amending Town Ordinance No. 1198, regulating traffic and establishing fines and penalties for violations of traffic regulations in the Town of St. John, Lake County, Indiana, be, and the same is hereby amended to read and provide hereafter as follows, namely:

“Sec. 13-1004. Schedule 4, parking time limited to certain streets.

(a) This Section may be cited as Schedule 4.

(b) There shall be no parking on school days when school is in section from 6:30 a.m. to 8:30 a.m., Monday through Friday, on the streets listed below, namely:

Ventura Estates:
Dena Court;
Heather Court;
Judith Lane;
Kelly Court;
Kelly Drive;
Leonardo Drive;
Ventura Drive; and
W. 85th Place.

Heron Lake Estates:
Barberry Court;
Hawthorne Drive;
Heron Lake Road;
Knickerbocker Place;
Osage Drive;
Sesame Street;
Wildwood Drive;
W. 83rd;
W. 82nd Court; and
W. 81st Court.

(c) Residents of the streets set forth in Sub-section (b) above are permitted to park their vehicles on the street between the hours of 6:30 a.m. and 8:30 a.m., Monday through Friday, when school is in session only if they are properly possessed of an display the appropriate parking permit issued by the St. John Police Department.

(d) Residents of the streets set forth in Sub-section (b) above must provide vehicle ownership proof to the Town of St. John Police Department by way of registration and/or title documentation for any vehicles they own or lease and are registered at the addresses set forth above, for any vehicles registered to businesses they own, and for any vehicles that are registered to businesses for which they are employed before the Town of St. John Police Department will issue a parking permit for such vehicles. Only vehicles registered as set forth above shall be issued a parking permit.

(e) Notwithstanding anything in this Section to the contrary however, business or commercial vehicles shall be exempted from this Ordinance and may be parked on the streets and locations set forth above when necessary for the performance of commercial professional, or business services at the state locations. It is intended that construction vehicles and construction workers also be exempted while engaged in construction work on site.”

SECTION TWO: That all remaining terms and provisions of Town Ordinance No. 1287, amending Town Ordinance No. 1198, each of which originate from Town Ordinance No. 511, not amended hereby are ratified and reaffirmed.

SECTION THREE: That all existing Ordinances, and Town Code sections, or parts thereof, in conflict with the provisions of this Ordinance, are hereby deemed null, void, and of no legal effect, and are specifically repealed.

SECTION FOUR: That if any section, clause, provision, or portion of this Ordinance shall be held to be invalid or unconstitutional by any Court of competent jurisdiction, such decision shall not affect any other section, clause, provision, or portion of this Ordinance.

SECTION FIVE: That this Ordinance shall take effect, and be in full force and effect, from and after its passage and adoption by the Town Council of the Town of St. John, Lake County, Indiana, and publication in conformance with applicable law.

ALL OF WHICH IS PASSED AND ADOPTED THIS 26 DAY OF February, 2015, BY THE TOWN COUNCIL OF THE TOWN OF ST. JOHN, LAKE COUNTY, INDIANA.
