ORDINANCE NO. 1597
AN ORDINANCE CREATING A FEE SCHEDULE AND SPECIAL NON-REVERTING FUND FOR THE USE OF THE TOWN OF ST. JOHN DOG PARK AND ALL MATTERS RELATED THERETO.
WHEREAS, the Town Council of the Town of St. John, Lake County, Indiana (hereinafter the “Town Council”), did on the 29th of January, 2015, approve the construction of a Dog Park at “Homestead Park East” in the vicinity of 99th and Hedwig Drive; and
WHEREAS, the Town Council has been informed that the St. John Park Board has, at its January 24, 2015, Public Meeting, adopted Resolution No. 15-02-24 PK recommending to the Town Council the adoption of an Ordinance establishing Rules and Regulations and a fee structure for use of the St. John Dog Park; and
WHEREAS, the Town Council has received and reviewed the Resolution of the St. John Park Board pertaining to the adoption of an Ordinance establishing Rules and Regulations, and fee structure, for use of the St. John Dog Park, and, having considered same, now concurs and agrees that it is appropriate, advisable, and in the best interests of the residents of the Town of St. John to establish a fee schedule for the use of the Town of St. John Dog Park facility by participating residents and citizens.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF ST. JOHN, LAKE COUNTY, INDIANA, AS FOLLOWS:
SECTION ONE: That the Fee Schedule for the use of the St. John Dog Park, attached hereto, incorporated herein and marked as Exhibit “A” is hereby approved and adopted as the Participant/User Fee Schedule for Use by residents and citizens of the St. John Dog Park Facility.
SECTION TWO: That there is hereby established the “TOWN OF ST. JOHN DOG PARK SPECIAL REVENUE NON-REVERTING FUND”, which shall be a Special Revenue Non-Reverting Fund under the rules, regulations and requirements of applicable Indiana Law, including the Indiana Code, as amended from time to time, as well as the Administrative Rules and Requirements of the Indiana State Board of Accounts, as also amended from time to time.
SECTION THREE: That all participant/user fees collected by the Department of Parks and Recreation from residents and citizens for use of the Town of St. John Dog Park, as established herein, shall be deposited into the “TOWN OF ST. JOHN DOG PARK SPECIAL REVENUE NON-REVERTING FUND”. The participant/user fees for use of the St. John Dog Park collected under the provisions of this Ordinance and deposited into the “TOWN OF ST. JOHN DOG PARK SPECIAL REVENUE NON-REVERTING FEE FUND” shall be utilized and expended for the maintenance, operation, and upkeep of the St. John Dog Park Facility, as well as all related administrative costs and expenses related thereto, and no other.
SECTION FOUR: That the Clerk-Treasurer of the Town of St. John is authorized and directed to take all appropriate required actions to establish said “TOWN OF ST. JOHN DOG PARK SPECIAL REVENUE NON-REVERTING FUND” in conformance and compliance with all applicable law, as amended from time to time.
SECTION FIVE: That all existing Ordinances and Town Code provisions, or portions thereof, in conflict with the provisions of this Ordinance are, hereby deemed null, void, and of no legal effect, and are specifically repealed.
SECTION SIX: If any section, clause, provision or portion of this Ordinance shall be held to be invalid or unconstitutional by any Court of competent jurisdiction, such decision shall not affect any other section, clause, provision or portion of this Ordinance.
SECTION SEVEN: That this Ordinance shall take effect, and be in full force and effect, from and after its passage and adoption by the Town Council of the Town of St. John, Lake County, Indiana, and publication in conformance with applicable law.

FEE SCHEDULE – WIGGLEY FIELD DOG PARK
Participant users are required to purchase a permit each calendar year at the St. John Town Hall, 10955 West 93rd Avenue.
Permits are valid on a calendar year basis (January 1 through December 31). For the initial permit period, permits issued in 2015, or anytime in 2016, shall be valid for the calendar year ending December 31, 2016.
Thereafter, permit issuance to participant users shall be on a calendar year basis, no matter when issued in the calendar year.
Proof of current vaccinations is required. Rabies, DHPP (Distemper, Hepatitis, Parainfluenza, Parvovirus). Bordatella is not mandatory, but is strongly recommended.
Annual Participant/User Fee for St. John Residents: $25.00 – one dog; $10.00 each additional dog.
Non-Resident Participant/User Fee: $100.00 – one dog; $25.00 each additional dog.
Replacement card: $10.00 if card is lost or damaged.
