CHOICES FOR DEALING WITH THIS TRAFFIC CITATION
CHOICE #1: PAY THE FINE
The
fine for any Ordinance 511 violation is: $180.00

payments must be either made in cash or via money order or certified
check made payable to the Town of St. John and paid in the
Clerk-Treasurer's Office. For your convenience, the drop box located in
the back of the Town Hall may be used if you have a money order or
certified check for payment. DO
NOT MAIL OR DEPOSIT CASH! Please include your copy of the
traffic citation along with payment.
CHOICE #2: COURT
If
you do not pay the fine prior to the specified time limit (within 14
days of receiving the citation), the traffic citation will be forwarded
to Lake County Superior Court. Your case will be assigned an appearance
date, and you will be notified via mail of the date and location by
Lake County. You will be required to appear on that date and at the
assigned location, at which time you may either plead guilty and pay
the fine, or plead not guilty. If you choose to plead not guilty, you
will have the opportunity to plead your case before the assigned Lake
County Court, which will make the final decision regarding the
disposition of your case.
CHOICE #3: DEFERRAL PROGRAM (If
Eligible)
Enter
into an Infraction Deferral Agreement with the Town of St. John, which
states the defendant agrees:
1a. To pay the user's fee and court cost of $184.00 in accordance with I.C. Sec. 34-28-5-1. 1b. That the Defendant will commit no criminal traffic offenses or moving traffic violations for a period of six (6) months from the date of the agreement. Defendant affirms under the penalty of perjury pursuant to I.C. Sec. 35-44-2-1 that: 2a. All information is true and accurate. 2b. The violation is not associated with an accident, property damage or other criminal charge; 2c. The defendant has not been charged with a criminal offense or been issued a moving traffic violation within the last year in any State; and 2d. The defendant has not been charged with a speeding offense in excess of thirty (30) miles per hour over the posted speed limit. To enter into the Deferral Program, the defendant must apply in person at the St. John Police Department, located at 11033 W. 93rd Avenue, St. John, Indiana, between the hours of 8 AM to 10 PM, Sunday through Saturday. All payments must be in the form of a certified check, money order, or cashier's check and made payable to the "Clerk, Lake Superior Court." Cash and personal checks CANNOT be accepted. THIS FEE IS NONREFUNDABLE. Upon completion of the Deferral Program terms (6 months), the citation will be dismissed and no points will be assessed to the defendant's driving record. If the defendant fails to meet the requirements of the agreement, the agreement is considered null and void. The fee is not refundable and cannot be applied to the fine. IF YOU FAIL TO RESPOND TO THE TOWN OF ST. JOHN WITHIN FOURTEEN (14) DAYS, YOUR TICKET WILL BE FORWARDED TO LAKE COUNTY FOR PROSECUTION. |
